Your Absolute Right to Silence: Article 31, UCMJ Explained

Unlike civilian law enforcement, which relies on the Fifth Amendment and Miranda warnings, military members are protected by a distinct and powerful statutory shield: Article 31 of the Uniform Code of Military Justice (UCMJ).

If you are suspected of an offense, any military investigator, commander, or supervisor who questions you MUST advise you of your rights before asking a single question. If they fail to do so, anything you say is inadmissible.

1. What Does Article 31 Cover?

Article 31(b) states that no person subject to the UCMJ may request any statement or interrogate a suspect without first:

  • Informing them of the nature of the accusation.
  • Advising them that they do not have to make any statement.
  • Warning them that any statement they make may be used against them in a trial by court-martial.

2. The "Command Influence" Trap

Because of the strict hierarchy in the military, a commander or NCO asking "informal" questions can feel like a direct order. Under Article 31, a military superior cannot order you to incriminate yourself.

If your commander asks you, "Did you fail the urinalysis?" or "What happened at the barracks last night?", they are conducting a suspect interview. They are legally required to read you your Article 31 rights first. If they do not, they have violated military law.

3. The 3 Things You Must Do

If you are stopped by CID, Military Police, or your command:

  1. State clearly: "I am exercising my Article 31 right to remain silent."
  2. State clearly: "I want an attorney."
  3. Do NOT sign any waiver forms. CID will present a Form DA 3881 (Rights Warning Procedure). Check the box stating you refuse to make a statement and request counsel.
